Terms of Service

By accessing or using The Green Easel website (the “Site”), you agree to be bound by the following Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Site.

1. Overview

The Green Easel provides an online marketplace for independent artists to list and sell original artwork and handmade items to buyers. We are not a party to transactions between users. We simply facilitate the connection, transaction, and communication.

2. Eligibility

To create a vendor account and sell art on The Green Easel, you must be:

  • At least 18 years old or the age of majority in your jurisdiction
  • Able to form a legally binding contract
  • Not previously banned from the platform

Buyers must be at least 13 years old. If you are under 18, you may only use the platform to make purchases with the involvement and consent of a parent or guardian. You are responsible for ensuring that your use of the platform complies with all applicable laws and regulations.

3. User Accounts

You may need to create an account to buy or sell on The Green Easel. You agree to:

  • Provide accurate and complete information
  • Keep your login credentials secure
  • Be responsible for any activity under your account

We reserve the right to suspend or terminate accounts that violate our policies or Terms.

4. Listing and Selling

Sellers are responsible for:

All sales are binding once a buyer submits payment, unless otherwise canceled under our Cancellation Policy.

5. Buying

Buyers agree to:

  • Read listings carefully before purchasing
  • Pay promptly using approved methods
  • Only request returns/refunds in line with our [Return & Refund Policy]
  • Not attempt to transact off-platform

6. Fees

The Green Easel takes an 18% commission for each sale made. The amount that the artist will earn is displayed when artists list their work to ensure transparency of earnings. The Green Easel may charge transaction or service fees for use of the platform. These fees will be clearly disclosed before you list an item or make a purchase. We reserve the right to change fees with prior notice.

7. Marketing Content

The Green Easel reserves the right to use photos of vendor’s artwork in their marketing platforms, including but not limited to Instagram, Tik Tok, and paper flyers.

8. Disputes

If a dispute arises between users, we encourage direct communication first. If no resolution is reached, The Green Easel may help mediate per our [Dispute Resolution Policy]. Final decisions rest with The Green Easel and/or the payment processor (e.g., PayPal).

9. Intellectual Property

All artwork listed must be original or legally authorized for sale by the seller. By uploading images or content to The Green Easel, sellers grant us a non-exclusive, royalty-free license to use such content for promotional or operational purposes.

10. Prohibited Use

You agree not to use The Green Easel to:

  • Violate any laws or regulations
  • Sell prohibited or counterfeit items
  • Harass or defraud other users
  • Interfere with the operation of the Site or other users’ enjoyment

11. Account Suspension

We may suspend or terminate your account without notice if:

  • You violate these Terms or any of our policies
  • We suspect fraud or illegal activity
  • Your behavior harms the safety or integrity of the marketplace

12. Limitation of Liability

The Green Easel is not liable for:

  • Any direct, indirect, incidental, or consequential damages from your use of the Site
  • Disputes between buyers and sellers
  • Lost or damaged shipments

Our maximum liability under these Terms shall not exceed the total fees you paid us in the 3 months prior to the event giving rise to the claim.

13. Changes to These Terms

We may update these Terms occasionally. If we do, we’ll notify you by posting the updated version with the new effective date. Your continued use of the platform after changes go into effect means you accept the new Terms.

14. Governing Law

These Terms are governed by the laws of the state of New Jersey, without regard to conflict of laws principles.
